South Dakota Adopts Remote Notary Requirements

The legislature of South Dakota has enacted House Bill 1272, An Act to provide for remote notarization.  Similar to neighbor state North Dakota, South Dakota defines communication technology as “an electronic device or process that allows a notarial office and a person not in the physical presence of the notarial officer to communicate with each other simultaneously by sight and sound.” 

The Act outlines the requirements a notary must meet to perform a remote notarial act.  The notary must have personal knowledge of the identity of the person, be able to confirm the document before the person is the same document before the notary, and must include in the certificate, along with signature, the remote location of the person and that the person appeared before the notary using communication technology.
