New Hampshire Amends Provisions Regarding Registry of Deeds Documents

On June 28, 2013 the state of New Hampshire Amended provisions regarding Registry of Deed documents. The amendments will take effect on August 27, 2013. The bill requires that the registry of deeds remove all social security numbers, armed forces service numbers, credit card numbers, and deposit account numbers on documents that are made available on the internet that a register discovers in the ordinary course of business.

Records:  Social Security Numbers, Armed Forces Service Numbers and Financial Information

The preparer of a document shall not include an individual’s social security number, armed forces service number, credit card number or deposit account numbers in any document that will be presented for recording at the registry of deeds. This no way applies to state or federal tax liens and certified copies of death certificates that are filed or recorded in the registry of deeds.

If a document that includes any of the above information was filed with the registry of deeds and is available on the internet and if the information is discovered by the register of deeds in the ordinary course of business after August 27, 2013, the register must remove the information from the internet record. Also, the register shall establish a procedure in which individuals may request this information be removed from it files that are available on the internet. Once the request has been made the register has 5 business days to comply with the request of the individual. The register may be required to comply sooner if the court has ordered to have the information removed for good cause shown.
