Delaware Updates Requirements for Filing Mortgagee Change of Address
The State of Delaware has amended Title 25 § 2124 of the Delaware Code to require a statement of mortgagee address change be filed in the recorder of deeds office within 60 days of the change.
The notice must be filed with the recorder of deeds office in the county in which the mortgage has been recorded; however, a separate notice is not required for each mortgage recorded in the county, and the statement of address change need not include reference to each mortgage recorded in the county.
The amendment additionally strikes the sample form previously included and instead instructs that each recorder of deeds may promulgate a sample form that may be used to comply with the requirements. Additionally, the recorder of deeds office must maintain a separate index for statements of mortgagee address change.
